The bottom line

Legal, licensable, and not owner-occupancy restricted

Henderson permits short-term vacation rentals without requiring you to live in the property. That single fact makes it the default recommendation for investors in this valley. The catch is not permission — it is eligibility of the specific parcel. A 1,000-foot radial separation between permitted units plus density caps means the answer for any given address is often no, and the only way to know is to check that address.

Henderson's standards live in HMC 19.9.4.F of the Development Code, administered through the city's business licensing function. The program is mature, the requirements are documented, and there is no federal litigation clouding enforcement the way there is in the unincorporated county. For a client who wants an STR that they can finance, insure, and eventually sell without a regulatory asterisk, this is where we start.

Permit requirements

Separation and density caps — the real gatekeeper

This is where most Henderson deals die, and it is the reason we check a parcel before a client gets attached to a house.

“Approved in this neighborhood” is not “approved at this address”

Because separation is measured radially from existing permitted units, two houses on the same street can produce opposite answers. Do not rely on a neighbor's permit, an agent's assurance, or a listing that says “STR potential.” The city maintains the mapping that decides this. Get the address checked.

None of these are expensive individually. Budget for them anyway, along with the inspection itself, so your first-year pro forma is not surprised.

Application process

  1. Check parcel eligibility firstSeparation and density are the binding constraints. Establish that the address can qualify before spending anything — and certainly before removing a contingency on a purchase.
  2. Confirm the HOA positionHenderson is dense with planned communities and associations. A CC&R prohibition ends the matter regardless of what the city would approve. Get the current governing documents and rules, not a summary.
  3. Prepare the application packageProof of ownership, the signed acknowledgement form, $1M general liability certificate, local contact designation, and property details.

The transfer trap

Permits do not convey with the property

Henderson's position is plain: permits do not transfer at sale, and every buyer re-applies under current rules. That has three consequences most buyers do not price.

One: a listing marketed as a “permitted short-term rental” is describing the seller's permit, not an asset you are acquiring.

Two: you re-apply under current rules — which may be stricter than the rules in force when the seller was approved. Separation and density are measured against today's map, not the map from three years ago.

Three: there is a real possibility of buying a home that operated legally as an STR and being unable to license it yourself. If your underwriting depends on STR income, your purchase contract needs to account for that risk explicitly. We write that language for our clients.

Taxes

The combined transient lodging tax rate for short-term vacation rentals in the City of Henderson is 13% of total rental revenue for the month, applied to the listing price including cleaning and guest fees for the first 31 nights of any reservation. Reservations longer than 31 nights are exempt. The report and payment must be received by the 15th day of the following month.

The part almost every guide gets wrong

Under AB 363, effective July 1, 2022, Accommodations Facilitators — the booking platforms — are required to collect and remit transient lodging tax for Nevada short-term vacation rentals. Owners booking through a platform should not be separately collecting and remitting it.

But here is the trap: Henderson registrants must still file the monthly transient lodging tax form regardless. Filing and paying are two different obligations, and hosts who assume the platform handling payment means they have nothing to file are wrong. And if you rent without a facilitator — any direct booking — the collection obligation is back on you.

One more thing worth knowing: the owner/operator is liable to the City of Henderson for transient lodging tax whether or not the tax was actually collected from the guest. Failing to collect does not eliminate the obligation; it just means you pay it out of your own margin.

Do I have to live in the property?

No. Henderson does not impose the owner-occupancy requirement that the City of Las Vegas does. This is the single biggest reason investors focused on non-owner-occupied short-term rentals concentrate here. You do, however, need a designated local contact residing in Clark County who can respond quickly to problems.

How do I find out whether a specific address can qualify?

The city maintains the mapping that determines separation and density compliance, and that mapping is authoritative. Because the 1,000-foot radial measurement can produce opposite answers for houses on the same block, this has to be checked address by address. I am buying a home that is currently operating as an Airbnb. Am I covered?

No. The permit does not transfer. You re-apply under current rules, and current conditions may not support approval even though the seller was approved previously. Treat the seller's permit as evidence that it was possible once — not as an asset conveying to you. Verify your own eligibility during due diligence.

Can I short-term rent a condo in Henderson?

Potentially, subject to the multifamily cap limiting STRs to 25% of individually owned units in the building — and subject to the association's governing documents, which in condominium settings frequently prohibit short-term rental outright. Check the CC&Rs and the current rules before anything else.

Is Henderson affected by the Clark County injunction?

No. Henderson administers its own program under its own code. The federal litigation concerns unincorporated Clark County's ordinance and does not alter Henderson requirements or enforcement. More on the county situation.
