The bottom line

By permission, not by right

North Las Vegas adopted Ordinance 3127 in June 2022, aligning with Nevada's AB 363 and allowing short-term rentals through an approved Conditional Use Permit. You must have the CUP before you may apply for a business license. A CUP is a discretionary land-use approval decided at a public hearing where neighbors may appear and object — which means meeting every written standard does not guarantee you get it.

For an investor, this is a meaningfully different risk profile than Henderson. In Henderson, if the parcel clears separation and density, the path is largely administrative. In North Las Vegas, you can clear every measurable standard and still be denied because the hearing goes badly. Budget time, expect a process, and do not remove a purchase contingency on the assumption that approval is a formality.

Read the neighbor-notification requirement carefully

Being required to notify every owner within 200 feet is not a mailing chore. It is the mechanism that surfaces opposition into your hearing. If the surrounding block is hostile to short-term rentals — and in some North Las Vegas neighborhoods it is — you will find out at the worst possible moment unless you have done the work in advance. This is a factor we assess with clients before they commit.

The risk investors miss

Everywhere else in this valley, the question is “does the parcel qualify.” Here there is a second question: “will the body grant it.” Those are not the same, and conflating them is how people end up owning a house they cannot use the way they planned.

Do not close on the assumption of approval

If your underwriting depends on short-term rental income, a North Las Vegas purchase should not close before the CUP is resolved — or the contract should give you a clean exit if it is denied. We write that contingency language for our clients and we push for the timeline to accommodate it.

A denied CUP does not refund your purchase price. It converts your STR investment into a long-term rental, and the number that matters at that point is what the property produces on a 12-month lease. Know that number before you sign.

The offsetting consideration: North Las Vegas has historically offered lower entry prices than Henderson, and the 660-foot separation is far less restrictive than Henderson's 1,000 feet or the county's 2,500. For a buyer who can tolerate process risk and manage a hearing well, there is real opportunity here. It simply has to be entered with clear eyes.

Taxes

North Las Vegas administers transient lodging tax on short-term rentals through the city, at approximately 13%. Collect from the guest, remit on the city's schedule. Confirm the current rate and filing deadline with city licensing, and confirm what your booking platform remits on your behalf versus what remains your obligation. Direct bookings are always yours.

Can I apply for the business license and the CUP at the same time?

No. The applicant must receive an approved Conditional Use Permit before applying for the business license. Plan your timeline around a sequential process, not a parallel one.

What happens if neighbors show up and object?

Objections become part of the record the decision-making body considers. A CUP is discretionary — that is what distinguishes it from an administrative permit. Organized neighborhood opposition can defeat an application that meets every measurable standard. This is why we look at the neighborhood's history before a client commits, and why we do not treat approval as a formality.

Do I really have to install noise monitoring equipment?

Yes — exterior noise monitoring is a North Las Vegas requirement and one of the more distinctive features of this jurisdiction's approach. Treat it as a line item in your setup budget alongside furnishing and safety equipment, and understand it produces a record that can be referenced if complaints arise.

Does a CUP transfer to the next owner?

Do not assume so. Land-use approvals and business licenses are treated differently, and conditions attached to a CUP can be specific to the applicant and the operating plan. If you are buying a property with an existing STR operation, verify the transferability of both the CUP and the license in writing with the city during your due-diligence period. Verbal assurance from a seller or listing agent is not verification.

Is North Las Vegas affected by the Clark County injunction?
